On March 24, 2006 new direct-to-consumer permit legislation was signed by Governor Daniels. Only wineries who have not had a relationship with a distributor for the preceeding 120 days are eligible to ship to consumers. An initial on-site face-to-face transaction with the consumer is required. IN consumers may only receive off-site shipments if they have made a previous purchase on the premises of the winery. The law limits direct wine shipments to 24 cases from a winery to a consumer and a winery may not ship more than 3,000 cases into Indiana each year. There is a 24 case consumer aggregate total annually. The consumer is responsible for not exceeding the 24 case total. Applicants must register with the Secretary of State, pay taxes and file reports.
Distributor Prohibited
Winery must NOT have an active relationship with a distributor if they want to send wine shipments directly to consumers.
In order to send shipments for for both onsite and offsite sales to this region, supplier cannot have had a distributor relationship in the region in the last 120 days.
