Effective February 16, 2006 wineries may legally ship wine to consumers in Florida. Adult signature requirements such as those used in the FedEx and UPS wine shipping programs must be adhered to for all shipments. Wineries are obligated file a monthly report and pay excise taxes on direct wine shipments. Sales/Use taxes are to be reported and paid by the consumer. We recommend that wineries enclose a copy this form in their shipments to consumers. There are no quantity limits. There are 5 dry counties in Florida where direct wine shipments are prohibited.
Winery is required to pay sales, excise and/or markup tax to consumer’s region of residence.
Shipments to this region require an excise tax of $3.50 per 1 gallon on both onsite and offsite sales of sparkling wine, to be paid within 10 day after every month starting January 1
Shipments to this region require an excise tax of $2.25 per 1 gallon on both onsite and offsite sales of wine containing between 0% and 17.259% alcohol, to be paid within 10 day after every month starting January 1
Shipments to this region require an excise tax of $3.00 per 1 gallon on both onsite and offsite sales of wine containing between 17.259% and 100% alcohol, to be paid within 10 day after every month starting January 1
