Effective June 8, 2007 wineries are required to have a Direct Shipper’s License to ship wine to a resident of West Virginia. The Direct Shipper’s Application requires applicants to request a Letter of Good Standing from the State of California (or state of domicile) and provide a list of brands that are to be shipped to WV. A licensed winery may ship no more than 2 cases of wine per month to a consumer.Shipments to dry areas are prohibited. LLCs and Corporations must register with the WV Secretary of State and obtain a Certificate of Authority or an Exemption from Certificate of Authority. Excise, state and municipal taxes must be paid. The shipping container of wine must be clearly labeled to indicate that the package cannot be delivered to any person under the age of twenty one or to an intoxicated person. No adult resident or duly licensed retailer or distributor may advertise the availability of wines by shipment to residents of West Virginia. (H.B. 2636, effective August 1993 )(¶7341 §60-8-6).
Customer Aggregate Volume Limit
There is a limit on volume of total shipments from a winery to each consumer over a specified period of time.
This region has a limit of 2 cases per individualper month for combined onsite and offsite sales with the following exception: Maximum 9 liters per case.
